I think it was this patch that fixed it:

This was fixing a thinko on my part, not Pierre's.

This was fixed in CVS and subsequent snapshots.

AFAIK, if you stick with Cygwin 1.3.10, you won't see this problem since it
should have been introduced only in the fstat cleanup that happened after
the 1.3.10 release.
